Personally I find this part a little disturbing.

"Even occasional pictures found, rather than authored, by the member who is submitting it [with acknowledgement acoarst !]"

My guess is that so would ever poster in this thread if it was their image that was used somewhere else even with acknowledgement of course.

The idea, perhaps not stated in best clarity, is that in a group
discussion about pictures, if someone would like the group to
discuss a certain picture, or merely an aspect of a picture, that
someone can post the picture for purpose ... regardless of the
authorship of the picture. This is absolutely legit "fair use" by
all legal terms. Acoarst, one acknowledges that the pic is from
some other author, who should be credited if known. But if one
wishes to discuss an image from a magazine advert page then
it's waaaay unlikely the author is easily known. I spoze it would
be proper to credit it as "Pepsi ad, Time magazine, Oct 2016"
to stay on the safe side. But should the photographer, or Pepsi
PR staff, see it and feel "disturbed", thaz of zero concern here.

As to how any of us would feel, if our work was used in such a
manner, somewhere, the fact is: Thaz how it goes. Fair use is
well defined and if you don't like that, call your congressman
[who acoarst doesn't give a ratzazz]. You can just as well feel
that Traffic Court is nothing like a Justice Court. How tizz.

Also, this whole question of a minor aspect of the "Discussing
Pictures" concept is quite tangental. The original suggestion
was about having a place to actually discuss pictures, which
currently has no defined home anywhere on Camel.

---------------------------------------------------------------

Perznally, I imagine that "any of us" would be pleased to find
our work used for discussion in such a way ... unless one posts
mainly to collect 2-or-3-word drivel compliments like "I like",
"great capture", "love the lighting", etc etc. Real discussion is
often less complimentary, but real discussion needs a place to
be happening.

So, since a breath of life has been granted to this thread lately,
here's an imageworthy discussion. Got no clue as to it's author,
and you'll need to ignore the IQ problem as it's a thumbnail pic.

For starters I'll say that the thumbnail IQ nicely prevents
discussing techie stuff. I like the way the string bass gets
a "stolen moment" appearance on the right. I mean I like
that it occurs, but I wish it were handled differently. Also,
there's a lesson here for those who photograph vocalists:
Handheld mic makes for far more expressive possibilities
than those situations where the vocalist hasta deal with
a mic on a stand. Thaz about vocalists. Clearly, a singing
instrument player cannot have a handheld mic.

I do suspect that if seen in proper IQ and detail, this is
very likely quite a striking image.

Been a lawyer long? I think you would be wise to look at the actual law and the way it is interperted in the courts.

If the image is already online, posting a link to the image's original location is a legally safer approach than copying the image and reposting it here.

+1 !

Scoundrel points out an excellent solution.

Frankly, even following scoundrel's recommendation,
I would tend to post a really low rez thumbnail along
with the link. Low rez as low as about 100x100 pixels.

Reason I'd do that is the thumbnail is SO low rez it's
barely the actual picture itself, but it does allow each
discussion group participant to know at a glance if the
linked-to image is of any interest to the him or her ...
before even clicking the link. Tell me again that I have
no clue about fair use. My resume isn't online, so who
do you THINK I am, or am not ? "We" are quite amused.

---------------------------------------------------------

Is it a whole lotta too much trouble to just click a link ?
Often as not, yes, it sadly is ... due to the target pages
of the links being "messy". Messy ? Yeah, sites that ask
you to subscribe to access content, pages with many
embedded videos that bog down your connection, etc.

Not that I've changed my lawyerly mind about fair use,
but I'll repeat that scoundrel's suggestion is excellent,
and if I wanted to ask for discussion on an image I don't
own, I'd hope to find a copy of it on a "non-messy" site
or page. If the only version online is on a messy page, I
can most likely forgo asking for discussion. Not like my
whole galaxy rotates on that axis.

My advice would be to post only a link and obey rule 9 of the general posting rules:

Okeeedoke. Like everyone, I never read every word
