I took this off the internet from a film of me taken at a reception at a museum. I then played with it in photoshop using different plugins. What do you think?

Thank you both. Dame Edna actually wore these glasses a number of years ago. I had tried to buy them for 10 years but the shop would not sell them. I guess things were bad this year so he let me buy them. They are really a work of art up close. I keep them on display except for the few times I canwear them.

Interesting image.

"-no camera used".... but "from a film "

Alas, I thought I was going to see an image made entirely with graphics software.

I was also wondering if you obtained a use license from the film's copyright holder before you "took it off the Internet" to use for your own purposes? I notice you don't allow editing of your images here at PC.

I took it from a movie and I changed it more than 50%. I doubt anyone would think it came from the original image which was in the news media. So , I believe, I am clear legally AND I am not using it for commercial purposes. I hope that answers your question.

Your image was used in a editorial context, so a model release is not required. The fact you altered the image by more than 50% is irrelevant, as is the fact that the image is of you. The videographer, or whoever hired them if it was 'work for hire', owns the copyright to all of the images in the film.

There is a chance your use of the image may be acceptable under the "fair use" doctrine, but then again maybe not. Most people, having used someone else's copyrighted image, tend to interpret the "fair use " doctrine as favorably as possible for themselves. Understandably, the copyright holder tends to the other extreme and the courts usually fall somewhere in the middle if they're ajudicating an infringement suit.
