Default selling photos from parade

Hello.

Quick question. I got some good pictures from the Celtics victory parade last week.

Since this was a public event and I was on a city street shooting with my own camera, do I have the right to sell them?

Thanks,
Rich

You probably need to get permission from the NBA since the logos are owned by them. It would like taking a picture of a pepsi ad on the street and trying to sell that.

I don't know if your town laws are the same as mine but in Michigan if you are shooting photos on the street with the intention of selling them later you need:

1.) A vendor permit from the city.
2.) Model releases (perhaps) depending on the use of the photos.
3.) Rights to use logos etc.

The vendor permit is not enforced unless it becomes and issue. If you are approaching people after you take their photo and offering to sell it to them then the permit will become an issue. Even if you are not selling the photos on the street if the city wants to fine you they can.

Model releases are important. Anytime you sell a person's likeness you need a release. The only time this doesn't come in to play is when you are shooting for editorial purposes. This applies even in a public setting.

I am not a lawyer, however, so you should not take this as legal advice.
