i have searched and read every post that came up under this search but still dont have a "real" grasp on it. Lets say im taking photos at a wedding and there are recognizable people in the back ground. Do i need a release from them to host them on my website to hopefully draw in more buisness even if they are not the main focus? Or, im taking photos of someone and someone else walks past and gets in the shot. Do ineed a release from that person if these are to beposted.Of course in most cases I would "get rid" of the offender but someimtes it could end up ruining the photo. If im at an NHRA event shooting our car and 75 recognizable people are in the BG do i need 75 releases since they could be affiliated with NHRA when actually they are IHRA drivers.
i have concluded that as long as the images are artistic in style and not used for profit or in a way that DOES NOT suggest affiliation to what ever its OK. PLease keep it in simple terms as all the law articles ive read, just have me even more confused. __________________

Not an expert, but I do not believe you need a release for secondary subjects, usages your referring too.
I do not believe you can sell them to a 3rd party though, without a release. (someone outside the wedding party). |

For editorial usage, in most states you don't need releases of recognizable people in images. This means running in newspapers, newsmagazines, on your blog, selling prints, etc. There's a ton of gray area in terms of "editorial usage", so I'd play it safe when at all possible.
For promotional usage- i.e. advertisements, you need model releases for everyone involved. Spectators at sporting events usually agree to blanket releases as a condition in being allowed to attend by buying the ticket, whether they are aware of it or not. It is usually found in the fine print on the back of the ticket. I personally appear in an ad for student season tickets at a major, but in buying season tickets for a certain sport involving an oblong ball made of leather and large men in helmets and pads and attending I released my likeness while at the event for use by the athletics department, who in turn stuck me in a group of fans on an advertisement selling the same season ticket package to other students. |

You can sell copies to anyone without a release, but you shouldn't sell or license them for commercial use without relevant releases. More to the point, you need to pay the people that sign them, or the permission is not binding. At least you probably wouldn't be liable for damages if you still got permission without consideration.
As to who needs to give you permission, the question is whether these people look like they are playing an active part in the photograph, because it comes down to whether they can be construed as endorsing the commercial activity for which the photograph is used. This includes your sample gallery, but in general it's just not reasonable or practical to go about getting permission from all these people, let alone providing them with consideration. __________________
