Ok, JD. I just got the 40D right before Christmas and have played a bit with the Live View so here goes:

Press the menu button
Toggle to the 6th icon from the left
Scroll down to the 6th item down, which is Live View function settings
Press the Set button to select
Press again on the Live View shoot item and Enable it
Press Menu to exit
In any Creative Zone setting, press the Set button to enable/disable Live View

One catch with Live View is that you have to manual focus even if your lens is set to AF. :-(
